These Terms and Conditions define the general principles and manner of providing electronic services – Webinar by the Organizer pursuant to Article 8 paragraph 1 point 1 of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2017, item 1219, as amended).
Before enlisting, please read the following Terms and Conditions carefully.
§ 1. Definitions
1. The Organizer – jointly:
UXPin Inc., a Delaware corporation with a business address at 5940 S Rainbow Blvd Ste 400 #43216, Las Vegas, NV 89118-2507, United States, and
StackBlitz Inc., a corporation with a business address at 2443 Fillmore St 380-7122, San Francisco, California
2. Participant – a natural person participating in the Webinar organized by the Organizer.
3. Consumer – Webinar Participant who is a natural person who purchases a product for purposes not directly related to his professional or business activity.
4. Webinar – online training organized by the Organizer for Participants.
5. Act – Personal Data Protection Act of 10 May 2018
6. GDPR – General Data Protection Regulation of 27 April 2016 (Dz. UE L of 2016 No 119/1).
§ 2. Technical conditions
To participate in the Webinar, you need a computer or other electronic device with access to the Internet, an active e-mail account and appropriate software, including a proper web browser. The Webinar will take place via the Zoom program, which the Participant can use via a link via a web browser.
§ 3. Registration for the Webinar service
1. In order to register for the Webinar, the Participant should provide an e-mail address.
2. The Participant is obliged to read the Terms and Conditions and confirm their acceptance by submitting a statement "I accept the Terms and Conditions ".
3. The Participant has the opportunity to submit statements of consent to conduct direct marketing of products and services and to receive commercial information from the Organizer by electronic means. Expressing consents is voluntary and does not condition the execution of the order.
4. The Webinar service is free of charge.
5. After submitting the application, the Participant will receive a confirmation of registration for the Webinar. Upon receipt of confirmation of the subscription, a contract for the provision of electronic services is concluded.
6. The Participant may resign from participation in the Webinar at any time.
§ 4. Rules of participation in the Webinar
1. After completing the registration, the Participant will receive the Terms and Conditions along with a link enabling participation in the Webinar to the e-mail address when ordering the service.
2. It is forbidden to transfer access data to participate in the Webinar to third parties.
3. The Organizer may provide the opportunity to interact with the speaker or other Participants through communication in the form of chat.
4. The Participant undertakes to use the service in accordance with the law, without infringing the rights and good name of third parties.
5. The Organizer may record, share and archive the course of the Webinar.
6. If the Participant during the Webinar discloses information constituting a trade secret or data subject to protection under separate regulations, he/she is obliged to inform the Organizer about it.
7. The Organizer reserves the right to make changes to the scope of the Webinar program or the technical conditions of its organization for important reasons, which will not constitute a violation of the Terms and Conditions.
8. The Organizer is not responsible for circumstances occurring on the part of the Participant that will prevent him from participating in the Webinar, including in particular:
a. incorrect contact details, b. failure by the Participant to meet the technical conditions necessary to provide the service, c. malfunction of ICT devices.
§ 5. Complaints
1. The Participant may submit a complaint related to the provision of the service by the Organizer. The complaint may be submitted in electronic form in the manner specified in the "Contact" tab on the Uxpin.com website.
2. The person submitting the complaint should provide their data, including contact details and a description of the reason being the basis for the complaint. Complaints that do not meet these requirements will not be considered.
3. The Organizer considers the complaint no later than within 14 days and responds to the e-mail address provided in the complaint.
§ 6. Consumer Provisions.
1. Each Participant may withdraw from the contract for the provision of electronic services at any time.
2. The Participant withdraws from the contract by submitting a statement of withdrawal to the Organizer.
3. In the event of effective withdrawal, the contract is deemed void and the Participant is free from any obligations.
4. The Organizer informs the Participant who is a Consumer about the possibility of using out-of-court complaint and redress methods. Rules for access to these procedures are available at the offices or on the websites of entities entitled to out-of-court dispute resolution. Information on the possibility for the Consumer to use out-of-court complaint and redress methods and the rules of access to these procedures are available on the following website http://ec.europa.eu/consumers/odr/.
§ 7. Intellectual Property/Copyright
1. Upon conclusion of the contract, the Participant obtains the right to access the content of the Webinar for its duration. These contents constitute a work within the meaning of the provisions of the Act of 4 February 1994 on copyright and related rights (Journal of Laws of 2016, item 666, as amended), they are intended for the personal use of the Participant. The Participant has no right to reproduce, reproduce, distribute, market the content of the Webinar or materials from the Webinar, or make this content available to third parties.
2. Participants are not entitled to record the content and course of the Webinar in any form without the written consent of the Organizer.
3. All rights, including economic copyrights, intellectual property rights to: the content of the Webinar and related materials, belong to the Organizer, and their use may take place only with the consent of the Organizer.
§ 8. Protection of personal data
1. The controller of the Participant's personal data is the Organizer (hereinafter referred to as the "Controller"). To the extent not described in these Terms and Conditions, the Uxpin Privacy Policy and the StackBlitz Privacy Policy apply.
2. In all matters regarding the processing of personal data and the exercise of your rights related to the processing of personal data, please contact us at hello@uxpin.com.
3. The processing of personal data will take place in order to:
organization of the Webinar – the legal basis is the necessity of data processing in order to conclude and perform the contract for the provision of the Webinar service (Article 6 (1) (b) of the GDPR)
keeping the Controller's accounting and tax settlements – the legal basis is the necessity of processing to fulfill the legal obligation incumbent on the Controller (Article 6 (1) (c) of the GDPR),
conducting direct marketing of the Controller's or his business partners' products or services (Article 6(1)(f) of the GDPR), while in the case of voluntary consent to such electronic action, the legal basis is Article 172 of the Telecommunications Law, Article 10 of the Act on the provision of electronic services)
organizational, administrative and IT services – the legal basis is the implementation of the legitimate interest of the Controller, which is the organization of the Webinar (Article 6 (1) (f) of the GDPR),
investigation and defense against claims and for archival purposes – the legal basis is the implementation of the legitimate interest of the Controller, which is the investigation and defense against claims and archiving of data (Article 6 (1) (f) of the GDPR).
4. Providing personal data is a condition for concluding a contract, the consequence of not providing them is the inability to participate in the Webinar.
5. Your personal data will not be used to make automated decisions, including profiling.
6. Personal data will be stored for the following periods:
to the extent necessary to perform the contract – for its duration,
in the scope of accounting and tax data – until the expiry of the limitation period for fiscal and accounting liabilities related to accounting documentation,
in the scope of consent – until its withdrawal.
to the extent that personal data is processed on the basis of the legitimate interest of the Controller – until this interest is pursued or until an effective objection is raised.
After these periods, we will process the data until the expiry of the limitation period for possible claims arising from the contract or the course of business contacts.
7. The recipient of your data may be:
entities providing services to the Controller (i.e. IT and technical support services, accounting, archiving, digitization and destruction of documents, marketing agencies, external auditors, consulting and legal companies), where such entities process data as subcontractors on the basis of a contract with the Controller and in accordance with his instructions,
independent external service providers, suppliers, partners, (m.in. postal and operational, financial and insurance services),
law enforcement and state authorities, when required by applicable law.
8. You have the right to:
access to the content of your data, request their rectification, deletion or limitation of their processing and – within the scope of the contract and consent – transfer personal data,
withdrawal of consent, however, the withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal,
object to the processing of personal data to the extent that the basis for the processing of personal data is the legitimate interest of the Controller;
lodge a complaint with the supervisory authority when you believe that the processing of your personal data violates the provisions of the GDPR.
§ 9. Final provisions
1. The Terms and Conditions are made available free of charge on the https://get.uxpin.com/stackblitz-friction-design-system-workflows/ website in a form that allows them to be obtained, reproduced and recorded in any form. The Participant may save the Terms and Conditions on any medium.
2. The Organizer reserves the right to make changes to the Terms and Conditions. The Organizer announces the content of amendments to the Terms and Conditions on the website at least 7 days before the changes come into force. The amendment to the Terms and Conditions enters into force within 7 days of publication. In addition, Participants are informed about any amendment to the Terms and Conditions by sending information to the e-mail address no later than 7 days before the date of entry into force of the amendment to the Terms and Conditions. If, within 7 days from the date of delivery of the e-mail referred to in the preceding sentence, the person does not inform the Organizer about the lack of acceptance of the amendment to the Terms and Conditions, he is bound by the Terms and Conditions in the new wording.
3. The Terms and Conditions and contractual relations between the Participant and the Organizer are governed by Polish law and are concluded in English.
4. In the event of a dispute arising on the basis of a concluded contract for the provision of electronic services, the Organizer and the Participant will strive to resolve the matter amicably. The law applicable to the settlement of any disputes arising under these Terms and Conditions is the Polish law.
5. The Terms and Conditions enter into force on 25.04.2023.
